Announcement – Town Planning Authority

The Government of the Republic of Cyprus, via the implementation of a series of drastic interventions, continues to support the development of the constructions’ industry by (a) the renewal of plans which proved to be beneficial; and (b) the adoption of new regulations and incentives. In particular, the Council of Ministers on the 24th of June, 2020approved new targeted interventions, which shall be valid until the 31st of December, 2021, as follows:

1. Measures for the legalization / licensing of new constructions and constructions which are not covered by a building permit in approved developments;

2. Plan for the provision of town planning incentives for the reinforcement of the tourism industry;

3. Plan for the provision of town planning incentives for the reinforcement of the developments’ activity:

With this decision of the Council, the Plan for the provision of Town Planning incentives with no. 75172 which was implemented for the first time on 29th of May, 2013 and was amended in 2015 and 2018, in order to encourage the development activity during the period of economic crisis, is extended until the 31st of December, 2021.

The particular Plan, as amended in 2018, sets out the partial compensation of the extra buildable area, depending on the category of THE development (i.e. 10% of the extra buildable area for additions to the existing tourist development; 15%of the extra buildable area for new tourism development, and 20% of the extra buildable area for the other developments) and the payment of the estimated amount to a Special Fund of the Cyprus Land Development Corporation, before the issuance of the Building Permit.

The Ministry of Interior, having evaluated the results of the Plan for the provision of Town Planning incentives, and given that: (a) from the date of initial implementation (29th of May, 2013 until the 30th of April, 2020) 840 Town Planning Applications have been submitted and 571 have been approved; (b) the objectives of the Plan have been achieved; and (c) due to the pandemic the whole economy of the Republic of Cyprus was severely affected, considers that the period of validity of the Plan should be extended until the 31st day of December, 2021.

The new proposal includes an additional regulation which provides for the payment of an additional 5% fee, in case the Applicant fails to submit an Application for a Building Permit within one (1) year after obtaining the Town Planning Permit.

4. Extensions to the validity of the planning and building permits:

The Ministry of the Interior, taking into account the consequences in the construction’s sector and the economy as a result of the extraordinary restrictive measures taken to face the pandemic, to the end of creating favourable conditions for a speedy recovery, the Ministry of the Interior recommends that the relevant Authorities grant an extension to the Town and Building Permits which precisely expired between the 17th of March, 2020 until 30th of June, 2020 and suggests that their validity be automatically extended until the 31st day of December, 2021.

5. Applicable from the 13th of july, 2020 and onwards:

There is no obligation for the Applicants who refer to the District Land Offices, Town Planning Authorities and Administration Offices to attach copies of the Title Deed and / or a Search Report obtained by the Land Registry;

In the case of Applications for Real Estate Development, the submission of the Real Estate Plan will not be required; and

The submission of a formal Real Estate Plan is replaced and substituted by the filing of an informal plan which can be extracted from the online Portal of the Land Registry.
